This action was commenced on April 11, 1955 by American Motors Corporation, formerly Nash-Kelvinator Corporation, a foreign corporation, plaintiff, against Richard Gourley and Industrial Commission of Wisconsin, defendants, to set aside the commissions findings, order and award made on March 24, 1955 wherein it was determined that Richard Gourley had sustained injury while engaged in performing services growing out of and incidental to his employment with the plaintiff company; that his injury arose out of the employment; and that he was entitled to benefits under the Workmens Compensation Act.
